PERSEPSI MASYARAKAT TERHADAP PERNIKAHAN PAKSA AKIBAT ZINA DALAM TINJAUAN HUKUM ISLAM

The phenomenon of forced marriage due to adultery is a social issue that still occurs in several areas in Aceh, including in Gampong Bukloh, Sukamakmur District, Aceh Besar Regency. This practice is based on the community's view that marriage is a solution to maintain family honour, while avoiding the social disgrace caused by extramarital relationships. However, from an Islamic law perspective, marriage has a key requirement, namely the consent of both parties. This study aims to analyse the community's perception of forced marriage due to adultery and review it from an Islamic law perspective. The research method used is a qualitative approach with in-depth interviews with community leaders, village officials, and the families of the perpetrators. The results show that most people still consider forced marriage to be the best way to resolve adultery, although there is a small group that rejects this practice because it is considered contrary to the principle of consent in marriage contracts. From an Islamic legal perspective, forced marriage is not justified because it contradicts the principle of freedom of choice (ikhtiyar) and the purpose of marriage as mitsaqan ghalizha. Therefore, more intensive Islamic legal education is needed so that the community understands that adultery cases do not have to be resolved through forced marriage, but rather through established Sharia legal mechanisms.
