Abstract

The urbun sale and purchase transaction is one of the economic practices that has attracted attention in the study of Islamic fiqh. Urbun is a concept in which the buyer pays part of the price of the goods to the seller as a guarantee of his seriousness in making the purchase. This study aims to analyze the urbun sale and  purchase  transaction  from  the  perspective  of  maslahah  (benefit)  and mafsadah (harm) in the schools of fiqh. The research methodology involves a comparative analysis between the views of several leading schools of fiqh, including the Syafi'i, Maliki, Hanbali and Hanafi schools. The findings of the study show that there are variations of opinion among the madhhabs regarding the legality, maslahah, and mafsadah in urbun sale transactions. Some madhhabs may see urbun as a practice that can provide benefits to the parties involved, while others may see it as potentially causing harm. The results of this analysis are expected to provide a better understanding of the legal and moral implications  of  urbun  sale  transactions  in  the  context  of  justice  and  social welfare in Islamic society.
