Abstract

This research is raised about the practice of distributing zakat in the fi sabilillah part of Baitul Mal Aceh, in this case the author makes a legal comparison between the concept of fi Sabilillah in Baitul Mal Aceh and the concept of fi sabilillah according to the understanding of Shafi'iyah scholars. The evidence used by them is the same, namely Surah at-Taubah verse 60. The condition shows that there is a difference in understanding the naṣ. Therefore, research is important because it will reveal the diversity of understanding of Baitul Mal Aceh and Shafi'iyah Ulama. The problem in this study is, how is the practice of distributing zakat in Baitul Mal Aceh and  what is the view  of fiqh Syāfi'iyyah about the practice of distributing zakat fi sabilillah in Baitul Mal Aceh. Based on the data collection method, this research is categorized as library research and field research. The findings of this research are first, Baitul Mal Aceh is an amil of zakat authorized by the Aceh Regional Government to manage and empower zakat by the decision of the Governor of Aceh (KGA). Furthermore, based on the naṣ interpretation of senif fi sabilillah, the Baitul Mal Aceh allows senif fi sabilillah to be given to all things that are good (fi sabilil khair) not only to people who are at war. In contrast to the Shafi'iyah Ulama who restrict it, so that senif fi sabilillah is only given to people who fight physical wars to exalt the religion of Allah. From the above explanation, it can be concluded that, Zakat part of fi sabilillah in Baitul Mal Aceh is distributed to all things that are good (fi sabilil khair) both in maintaining or preaching Islam, especially in areas prone to shallowness of faith, such as the construction of worship facilities, zakat discussion activities, assistance for Islamic organizations,  da'i in areas prone to faith, assistance for facilities and operations of educational institutions in communities that have not yet Empowered. This is because the meaning of fi sabilillah is not limited to military war. In the fiqh of Syāfi'iyyah, fi sabilillah is only for war volunteers who do not have a budget from the State. The practice of zakat in the fi sabilillah part of Baitul Mal Aceh is contrary to the majority of Syāfi'iyyah fiqh scholars.
